These Terms of Service (“Terms”) govern your use of foliarie.com and any purchase from Foliarie. The seller is JAKE RITZERT EG INC. By visiting the site, creating an account, or placing an order, you agree to these Terms.

If you do not agree, do not use the site.

These Terms are a contract. They are not legal advice.

1. Who we are

Foliarie is a brand of JAKE RITZERT EG INC.
We sell artificial floral home décor online.
We currently sell and ship to the United States only.

2. Eligibility

You must be at least 18 years old and able to enter a contract. If you use the site on behalf of a business, you confirm that you have authority to bind that business.

3. Account

You may shop as a guest or create an account. You are responsible for your login details and for activity under your account. Tell us at service@foliarie.com if you believe your account was used without permission.

We may refuse, suspend, or close an account if we believe these Terms, payment rules, or the law have been violated.

4. Products and descriptions

We sell artificial flowers and related décor. Product photos, colors, measurements, and weights are provided as accurately as practical. Flower heads are irregular, so height, width, and appearance may vary slightly. Color may also vary by screen, batch, and lighting.

A product is not guaranteed to match a screen exactly. Listings describe artificial décor, not fresh-cut flowers.

We may update product information, prices, and stock at any time. If we find a material error after you order, we may cancel the order and refund you.

5. Prices and payment

Prices are in U.S. dollars and do not include shipping unless the order qualifies for free shipping or the listing says otherwise.

U.S. standard shipping is $6.99. Orders of $35 or more receive free standard shipping. Taxes are calculated at checkout where applicable.

We accept the payment methods shown at checkout. Payment is processed by Shopify Payments and other processors displayed at checkout. You confirm that the payment information you provide is authorized.

An order is an offer to buy. We may accept or decline that offer. Acceptance occurs when we send an order confirmation or ship the item. If we decline or cannot fulfill an order, we will refund any amount charged.

6. Orders and cancellation

Please review your cart before paying, including color, quantity, and shipping address.

If an order has not shipped, email service@foliarie.com to request cancellation. If we can stop the shipment, we will refund the original payment method within 5–10 business days.

If the order has already shipped, use the Return & Refund Policy after delivery. We do not offer exchanges. To obtain a different color or product, request a refund and place a new order.

We may cancel an order for suspected fraud, pricing error, stock issues, or shipping restrictions.

7. Shipping

We ship within the United States only. We do not ship to P.O. boxes if the carrier we use cannot deliver to them.

  • Processing time: 1–2 business days
  • Standard transit after shipment: 3–5 business days

Delivery dates are estimates, not guarantees. Weather, carrier delays, incorrect addresses, and events outside our control may extend delivery.

Risk of loss passes to you when the carrier delivers the parcel to the address you provided, or according to the carrier’s delivery rules. If tracking shows delivered and you did not receive the parcel, contact us within 48 hours and also contact the carrier.

You are responsible for providing a complete and accurate shipping address. Extra carrier fees caused by an incorrect address, a refused package, or a failed delivery attempt may be deducted from a refund where permitted.

8. Returns and refunds

Returns and refunds are governed by our Return & Refund Policy, which is part of these Terms.

Summary only:

  • Request a return within 30 days of delivery
  • Email service@foliarie.com and wait for approval before shipping an item back
  • We do not exchange items
  • If the return is not caused by a product or shipping problem, you pay return shipping
  • If the item is damaged, defective, wrong, missing, or materially not as described, Foliarie covers return shipping
  • Approved refunds are issued to the original payment method within 5–10 business days after inspection

If there is a conflict between this summary and the Return & Refund Policy, the Return & Refund Policy controls.

9. Acceptable use

You agree not to:

  • Use the site for any unlawful purpose
  • Interfere with the site, checkout, or other users
  • Scrape, copy, or harvest site content except as allowed by ordinary browsing
  • Submit false orders, false claims, or false payment information
  • Attempt to gain unauthorized access to the site or related systems

We may refuse service or cancel orders connected to this conduct.

10. Intellectual property

The Foliarie name, logo, product photos, descriptions, graphics, and site design are owned by JAKE RITZERT EG INC or used under license. You may not copy, resell, or reuse them without our written permission, except for personal, non-commercial use of pages needed to shop.

Product names used only as descriptions of flower types are not a claim to any third-party brand.

11. Reviews and messages

If you send a review, photo, question, or other content, you give us a non-exclusive right to use that content on the site and in our marketing. You confirm that the content is yours to share and does not infringe anyone else’s rights.

We may remove content that is false, unlawful, or inappropriate.

12. Disclaimer

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted or error-free service. Artificial flowers are decorative items. They are not toys and are not intended for children to chew, dismantle, or use near open flame.

Some states do not allow certain warranty limitations. In those states, the limitation applies only to the extent permitted.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAKE RITZERT EG INC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF USE, ARISING OUT OF YOUR USE OF THE SITE OR A PRODUCT.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud or personal injury caused by our gross negligence where such a limitation is prohibited.

14. Indemnity

You agree to defend and hold harmless JAKE RITZERT EG INC and Foliarie from claims, losses, and reasonable legal fees arising from your misuse of the site, your violation of these Terms, or your violation of another person’s rights.

15. Privacy

Our collection and use of personal information is described in our Privacy Policy. That policy is part of these Terms.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where federal law applies.

If you are a consumer, you may also have protections under the laws of your state of residence that cannot be waived.

17. Disputes

Before filing a claim, email service@foliarie.com and allow 30 days for us to try to resolve the issue.

If the dispute is not resolved, either party may bring a claim in the state or federal courts located in Pennsylvania, unless applicable consumer law requires another venue.

Nothing in these Terms limits your right to file a complaint with a government consumer-protection agency.

18. Changes

We may update these Terms from time to time. The “Last updated” date shows the current version. The version in effect when you place an order applies to that order. Continued use of the site after a change means you accept the revised Terms.

19. Other terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the Return & Refund Policy are the entire agreement between you and us for use of the site and for purchases from Foliarie.

You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a business transfer.
